Where is CBD Oil Legal in the United States?

Although CBD doesn’t include THC, or it has minute traces of THC such as in Full Spectrum CBD oil, many states have been hesitant to legalize it. It’s resulted in a legal grey area where it’s a non-psychoactive cannabis product that makes people uneasy but offers many benefits. So while it’s legal in the United States on the federal level, the states independently have the final say. You’ll need to drill down into whether it’s legal in your state or not.

States with fully legalized cannabis products

Cannabis products and legalization involve in recreational use, as well as medicinal use of cannabis. Each state has their age limit on purchasing these products, usually 18 or 21. When asking what state is CBD legal in, you’ll need to go through a longer list than you might expect.

States where CBD is legal include:

  • Alaska

  • California

  • Colorado

  • Illinois

  • Maine

  • Massachusetts

  • Michigan

  • Nevada

  • Oregon

  • Vermont

  • Washington

  • District of Columbia

Is CBD oil legal in all of these states? Yes, these states allow people to use all cannabis products freely after they meet the age requirements.

Is CBD legal in other states?

CBD legality by state gets more confusing when you bring in what is called, “Amber states.” These states allow for cannabis use only when the person has a prescription from a physician. Cannabis oil legality is caught in the medical marijuana craze, although it doesn’t have psychoactive effects or impactful levels of THC.

If you’re in these states, the answer to the question, “Do I need a prescription for CBD oil?” is yes, you do. These Amber states make it legal to purchase CBD oil with a prescription:

  • Arizona

  • Arkansas

  • Connecticut

  • Deleware

  • Florida

  • Hawaii

  • Louisianna

  • Maryland

  • Minnesota

  • Missouri

  • Montana

  • New Hampshire

  • New Jersey

  • New Mexico

  • New York

  • North Dakota

  • Ohio

  • Oklahoma

  • Pennsylvania

  • Rhode Island

  • Utah

  • West Virginia

Can anyone buy CBD oil in the amber-red states?

Cannabis oil legality in red states is pretty tricky. Most of these states have acknowledged the benefits of cannabis products for particular ailments or conditions. The reason that people question, “Is CBD Oil Legal in all States?” is because the red states almost all have exceptions.

For example, Alabama allows for the use of CBD oil to people suffering from severe or chronic seizures. While in Iowa, patients with cancer, epilepsy, and even ALS can get CBD products through limited dispensaries.

Can CBD be legal in all states?

Ideally, cannabis products would be legal across the board. However, many states are still holding out. There were many states not listed in the Amber-Red section, and there are three ongoing red states that don’t permit cannabis products at all regardless of medical conditions.

While some states don’t have clear laws on umbrella cannabis use, some are working to pass CBD focused laws. Texas recently passed a law that allows its residents to purchase hemp products as well as CBD products with low levels of THC. As more studies come out, many states are making their way toward becoming greener.
